Radke Post 31 Jan 2215 hrs:
Senator Jim Mehlhaff, your comments are obscene and shocking coming from an elected official. Private property rights are God-given and Constitutionally-protected. They are not yours to give or take from the citizens, sold off to the highest bidder. You speak in hypotheticals and potential money that will come to South Dakota. I speak in absolutes as our private property rights are non-negotiable.
Consent is the key factor here. Landowners can consent willingly to participate in a private Green New Deal carbon pipeline project, and if these companies enter into good faith negotiations, they can get the job done.
However, private property owners should also be able to say “No thank you.” Citizens have every right to control the land beneath their feet. Our founding fathers understood that well. George Washington said, “Freedom and property rights are inseparable. You can’t have one without the other.”
HB1052 will not stop a carbon pipeline project. However, it encourages good businesses who actually work alongside South Dakotans to come make deals and do their projects. But it also protects the people from the heavy hand of corporations coming in and using the extreme force of eminent domain and condemnations.
Listen to the people. They are who have built this state, and they will be here long after the carbon capture scam is broke and gone. You can take that to the bank. In South Dakota, we may be open for business, but we are not for sale.
Vote yes on HB1052. It’s the right thing to do.

Jim Mehlhaff With all due respect, Senator, I was very precise with my word choice. “Obscene” is defined as: offensive, rude, or shocking; abhorrent to morality or virtue; repulsive by reason of crass disregard of moral or ethical principles; so excessive as to be offensive. It was obscene to hear you so flippantly disregard the private property rights of the people, which by the way, we have enjoyed since America began and our statehood was established. It was obscene to hear you disregard personal freedoms and liberties.
It was obscene to learn you would be willing, with your vote, to not just put an “open for business” sign up in South Dakota, but an “open season on landowners” sign. Without proper protections, the taking and pillaging of private property will become common place. This is just the beginning.
It is obscene the way you have disregarded the 160 landowners who have experienced the EXTREME USE of eminent domain as their land has been condemned for a private company. Their suffering has been immense; their pain long enduring; and they are desperately seeking relief and Constitutionally certainly, but yes, let’s talk about fake economic development through the Green New Deal using OUR MONEY!
And it is obscene to hear an elected official talk with so much emotional sensationalism. “Not one more nickel will be spent!?” What a grand, wild hypothetical statement to make!
Landowners, sir, are already business owners; what farmers and ranchers do on the land is literally REAL AND LASTING economic development and business.
What you are suggesting by voting against HB1052 is that eminent domain is appropriate to be used to enrich a private company using our tax payer dollars. Yes, it’s obscene, and it’s just plain wrong.
CONSENT is and should be required by both parties entering into a business agreement. Do you really want to forcibly take land from people who do not want to participate in this boondoggle? Really? Truly? Is that what the people of your district elected you to do?
I pray you will reconsider your position on HB1052. The people have spoken on this issue. The Supreme Court has spoken on this issue. The House has spoken on this issue. And it is the duty of a legislator to act upon the legal question in front of them and do right by the people.
HB1052 is the right thing to do. It is a reasonable, commonsense solution to an ongoing problem, and South Dakotans are more than ready to put this chapter behind them. There is no black and white about it. There is no compromise on it.
Pass the bill. Do right by the people. The pipeline can still be built, but now these companies might actually have to treat the people well.
That’s what being a South Dakotan is all about, and that’s how business should be conducted.

My Comments on same Post!:
Nazario for Iowa
This is powerful and I must commend Amanda Radke for speaking TRUTH to POWER! Your words are powerful and should resonate with many hard working Americans.
We are tired of the political elites choosing corporations over people! The ROT within the establishment party must be exposed. It runs deep in many state legislatures. A chosen few, but powerful enough to inhibit the correct legislation from moving forward and protecting WE the People!
Private Property Rights MUST be defended and preserved at all cost. This is the hill with dying on! It will have a profound effect on the entire nation if we lose now.
Fight ON SD Warriors, Iowa and the great Midwest and Nation are watching.
The Green New Deal Scam must END and laid to rest! Many tax credits must end with it! These tax credits for Green New Deal Projects breed ABUSE among those that seek them.
Time to focus on the people of the state and the Republic! America First / South Dakota First and not a transfer of wealth to the elites through these GND hoaxes.
South Dakota is NOT For Sale!
