Insight from Congressman Steve King, ret.
“I have one objection to the summary. There is NO place in law that uses the term “public good” as is erroneously explained in the first paragraph with a footnote (public good.2). The use of the word “good” does not exist in the supporting article either. That’s the language creep the proponents of condemnation are slipping into our language. Public use is the standard. Public purpose was erroneously inserted into the Constitution in Kelo.
Public good is wide open ambiguous and would virtually eliminate property rights protections and allow takings by private entities under any excuse whatsoever. In other words, everything is for the public good in the eyes of someone. It even looks more like the public good when campaign contributions are flowing in. That keeps people in office who are, in their eyes, making all their decisions for the “public good”.”
